The FLSA is a federal law that establishes minimum wage, overtime pay, and recordkeeping requirements for most employees in the U.S. Under the FLSA, non-exempt employees must be paid at least the federal minimum wage and receive overtime pay at one and a half times their regular rate for hours worked over 40 in a workweek. ​

In many jurisdictions, commissions are considered wages once they are earned under an agreement, whether written or oral. Employers cannot withhold or refuse to pay commissions without cause, even after termination in many cases.
